Who these terms apply to
These Terms of Service ("Terms") constitute a legally binding agreement between Sunbelt Signal ("we", "us", "our"), a data intelligence business based in SW Florida, United States, and you ("you", "the subscriber", "the client") as an individual or entity accessing or purchasing our products or services.
What we provide
Sunbelt Signal provides data intelligence products and analytical services relating to the Florida single-family residential real estate market, including:
- Signal Pack reports (one-time county reports)
- Analyst and Portfolio subscription plans (quarterly reports and dashboard access)
- Institutional Retainer engagements (bespoke annual arrangements)
- Bespoke analytical and consulting services via Sunbelt Signal
The specific scope, deliverables, and pricing for each product are as described on the website at the time of purchase. For bespoke engagements, a written scope agreement will be provided before any work commences.
Nature of the service
Nothing provided by Sunbelt Signal constitutes financial advice, investment advice, or a recommendation to buy, sell, or hold any asset, property, or investment. All data, reports, scores, analysis, and communications are provided for informational and research purposes only. You must seek independent advice from a suitably qualified and licensed financial advisor before making any investment decision.
Sunbelt Signal is not a registered investment advisor, broker-dealer, or financial institution. We make no representations about the future performance of any market, county, asset class, or investment opportunity.
Billing, cancellation, and refunds
One-time purchases (Signal Pack): Payment is due at the time of order. Delivery is within 2 business days of cleared payment. Due to the bespoke nature of data reports, one-time purchases are non-refundable once the report has been delivered.
Annual subscriptions: Subscriptions are billed annually in advance via Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period and no further charges will be made. Partial-year refunds are not available for annual subscriptions.
Bespoke engagements: Payment terms will be set out in the written scope agreement. Typically a 50% deposit is required before work commences, with the remainder due on delivery.
All payments are processed by Stripe. Sunbelt Signal does not store or have access to your card details.
How you may use our products
Your subscription or purchase grants you a personal, non-transferable licence to use Sunbelt Signal data and reports for your own internal investment research and decision-making. You may not:
- Redistribute, resell, sublicense, or share access to any Sunbelt Signal product with third parties
- Use Sunbelt Signal data to build competing products or services
- Reproduce Sunbelt Signal reports or data in any publication, white paper, or marketing material without our prior written consent
- Use our data in a way that misrepresents its source, methodology, or conclusions
Institutional Retainer clients may request white-label or redistribution rights as part of their bespoke arrangement. This must be agreed in writing.
Ownership of content
All content produced by Sunbelt Signal — including reports, scores, methodology, dashboard design, and written analysis — remains the intellectual property of Sunbelt Signal. Purchase of a product grants you a licence to use the content as described above; it does not transfer ownership.
Source data used in our products is derived from publicly available US government sources and remains subject to its own respective terms of use.
Our liability to you
To the fullest extent permitted by applicable law, Sunbelt Signal's total liability to you for any claim arising out of or related to these Terms or our products shall not exceed the amount you paid to us in the 12 months preceding the claim.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or any investment losses, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded or limited under applicable law.
As-is provision
Sunbelt Signal products are provided on an "as is" and "as available" basis. We make no warranty — express or implied — that the data will be error-free, complete, or suitable for any particular purpose. See our full Data and Investment Disclaimer for further detail.
Jurisdiction
These Terms are governed by the laws of the State of Florida, United States. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Lee County, Florida.
Updates
We may update these Terms from time to time. We will notify active subscribers of material changes by email. Continued use of the service after the effective date of any change constitutes acceptance of the updated Terms.
